PChome & Skype is operated jointly by Linktel and Skype, and Skype is in charge of the administration and operating system services. During the process of your registration as a PChome & Skype user and your subsequent use of PChome & Skype service, both Linktel and Skype will collect, process, and use your personal data.
■ Scope of applicability
■ The purposes and categories of personal data collection
For the purposes of marketing, providing advertisements (including those provided by Linktel or third parties), customer management and service, operating telecommunication businesses and telecommunication value-added network businesses, providing network communication and information services, regulatory supervision of telecommunications and communications, providing internet shopping and other e-commerce services, fulfilling legal and contractual obligations, protecting the rights and interests of the parties and interested parties, providing after-sales services, and operating businesses in conformance with the lines of business specified in the business registration or articles of incorporation, Linktel, in accordance with the nature of each of those services, may possibly collect your name, contact information (including, but not limited to, telephone number, email address, and postal address), the name of the entity you work for, your occupational title, information necessary for completing collection o
In addition, to improve service quality, Linktel, in accordance with the nature of the services it provides, will record the user's IP address and the data of the activities engaged in by the user in using Linktel services (e.g. the telephone number dialed by the user and the location for communication selected by the user). But such data will be used only to analyze the network traffic and communication quality and to study network behavior so that the quality of Linktel services can be improved, and the data will be used only in aggregate analysis and will not be linked to any specific individuals.
In practice, you will be providing the following three types of data when you use the PChome & Skype service:
(1) Active data: Personal data that you voluntarily provide to PChome & Skype.
(2) Passive data: Data automatically generated by the system when you use the PChome & Skype service.
(3) User data: Data that you share with or communicate to other PChome & Skype users.
The three types of data are explained as follows:
Active data: Active data encompasses all information that is used to verify your identity and provide services for you, and such data includes your Skype user account and password, which are directly stored in the central servers of Skype. Active data also includes payment data in connection with your decisions about purchase of paid or value added services. Active data further includes other data that you voluntarily provide. For example, if you use the "Recommend PChome & Skype to Friends" function, you will be directed straight to one PChome & Skype web page containing a form that allows you to fill in one or more email addresses to invite friends to use PChome & Skype, and the information you have filled in the form will be temporarily stored in the server so that email notifications can be sent over to the friends you have recommended.
Linktel will use any letters spontaneously sent and questions or feedback filled in the forms by users to improve the software. Linktel also reserves the right to use those comments or feedback in marketing activities. If Linktel decides to disclose the comment of a user on the website or to use it in other types of marketing activities, Linktel will not disclose any information that is likely to reveal the identity of the user, or alternatively, Linktel will disclose the information only after obtaining the consent of the user.
Passive data: Passive data means information necessary for the provision of better functionality and improvement of service quality. Such information includes the version of the software you use. Passive data is generated automatically. Except for the various anonymous data collected by the system as statistics, none of the other information will be stored in the central servers. The statistics are used only to provide you with better service quality and to find out whether there is anyone attempting to vandalize the payment system or engage in other improper conduct.
User data: User data encompasses all of the data that you enter in the personal profile, including your name and email address. User data also includes your online status and your IP address, which is mainly used to enable other people to locate you more easily in the Skype network. Instead of being stored in the central servers, user data will be temporarily stored in the Skype network when you enter the data, and it is shared with other users by the user voluntarily. If you have not logged in your Skype account for more than one week, no one will be able to search out your data by using the search function, but other people may possibly become aware of your IP address through Skype.
For the convenience of its users, the Linktel websites may use web cookies to enable it to provide services better suited to the needs of individual users. Cookies are a type of technology allowing website servers to communicate with a user's browser, and may involve the storage of some data on the user's computer. The Linktel websites will also read information stored in the cookies on a user's computer. Users may use their browser settings to turn off or restrict this function, but this might result in the user being unable to use certain website functions. ■ The use of personal data
The personal data collected by Linktel that is sufficient to identify a user is provided only for processing and use by Linktel internally in accordance with the purposes of its collection. Linktel will not provide information sufficient to identify a user to any third party (either onshore or offshore), or use the data for any purpose other than the purposes for which it is collected, unless it gives prior explanation, or as necessary for the purpose of completing provision of services or fulfilling contractual obligations, or as necessary for the completion or execution of relevant services or functions for which you have already registered for use, or in accordance with applicable laws and regulations, or as ordered or requested by a competent authority so empowered.
Linktel will continue to retain, process, and use relevant information during the effective term of the Agreement and the period for which the information is required to be retained as provided by laws or regulations.
■ Sharing of user's resource
In the process of your use of the Skype service, part of the space of your hard drive, network bandwidth, and the operation of the central processing unit will be used to establish the communication between you and other users, and your computer will gradually become a supernode. Becoming a supernode means that when you use the Skype service on your computer, it will be configured as a hub and possibly used to assist other Skype users in communicating with other people and to achieve better communication quality. It also means that a user who cannot be directly connected to another party due to a firewall or other network restrictions will be able to indirectly reach the party that the user intends to call through the secure use of your computer connection. When your computer becomes a supernode in the Skype network because of your use of the Skype service, you may rest assured that the usual operation of the computer will not be affected.
■ Data security
Linktel will maintain the security of personal data by employing reasonable technology and procedures consistent with industry standards.
In the process of using Skype, the files in your computer, the information you transmit to Linktel, and the resource of your computer are all protected in accordance with advanced technologies. Protection mechanisms are in place for all of the data you provide, and the data searchable by others will be limited to only what you have set in the personal profile to be available for search by others. All passive data will be stored only temporarily in a secure database, and only anonymous statistics will be collected (with the exception of the data required for the billing systems of certain paid or value-added services that require Linktel to collect your information to confirm your identity and to comply with local laws and regulations). The resource of your computer will not be accessed by third parties because of the use of the Skype service.
■ Rights of the party whose data is collected
Users may log in to the PChome & Skype website to search or review their own personal data. If your personal data has changed, or you discover your personal data is incorrect, you may request revision or correction at any time.
The party whose data is collected may request a search or review of their own personal data or may request that the party be given a copy, provided that Linktel may collect necessary fees and costs at its discretion. When there no longer exists a purpose for collecting the data, or the prescribed period has expired, you may request that the data be deleted or that processing and use of the data cease, provided that this does not apply when the data is necessary for Linktel in its execution of duties or business.
If you wish to delete any user data that has been registered with PChome & Skype, you may contact Linktel by sending an email to the customer service mailbox, or alternatively, you may contact the customer service personnel of PChome & Skype directly using the problem reporting form provided on the website. After receiving your request for deletion of personal data, Linktel will confirm with you by email and inform you of its receipt of your message, and within the following 15 working days, Linktel will delete the related data to the greatest extent possible (with the exception of data for which retention is required by a law or regulation, and data in connection with improper or illegal use). IMPORTANT:
PChome & Skype may possibly be unable to completely remove your user account because of residual data left on the Internet after individual uses, and in such case, the account deletion procedure may possibly fail. In addition, to the extent permitted by laws and regulations, PChome & Skype reserves the right not to accept a request for account deletion.
■ Effects of exercising rights
